However, O’ Neil denied killing the 56-year-old woman but he is said to have participated in helping to dump her body in a septic tank, located in the yard at Lot 55 William Street, Campbellville.On Wednesday, Justice Roxanne George-Wiltshire upheld a no -case submission, presented, in the absence of the jury, by O’ Neil‘s Attorney, George Thomas.  As a result, she directed the jury to return a formal verdict of not guilty of murder in favour of the accused.However, State Prosecutors, Stacey Goodings and Diana Kaulesar have said that the State intends to appeal the acquittal.    In light of the circumstance,Clark Griswold Jersey, Prosecutor Goodings requested that O’ Neil be placed on bail.In response to the Prosecutor’s request,   Thomas argued that his client, who spent the last four years in prison, would not be able to afford bail. “He is a very poor man.” the lawyer said.Consequently, the Judge released O’ Neil on his own recognizance.Justice George overruled the no -case submissions presented by the Attorneys for Tyndall and Hope. He said that while inside the closet, for a few minutes, he heard a loud noise.  He said that he came out of his hiding place and peeped in another bedroom.There, he said that he saw the accused, (Hope) standing over his injured aunt with a piece of stick in his hand. Tyndall claimed after witnessing what his friend did to his aunt, he quickly left the premises. He said that he has no knowledge of what transpired afterwards.Hope, on the other hand, decided to give the court a sworn statement. The accused had initially opted to give an unsworn testimony but after consulting with his Attorney, he stood in the witness box to tell his story.The lawyer, Melvin Duke, said that the accused has a witness to call in his defence. As he related his story, Hope spoke slowly and quietly; his voice almost inaudible at times.Hope recounted that on the night of December 27, 2007 he saw his aunt Colleen and her granddaughter, Nikita Semple, at lot 55 Campbellville.The accused in answer to questions by his Attorney said that he was staying at the premises after he “came in the country.”  He said that he opted to stay there after his grandmother told him that her house didn’t have space.The accused said that while staying there, his aunt and her friend “Elder Smith” would visit the premises sometimes.Hope said that on the night of December 27, 2007 his aunt and Elder Smith had been in an argument. He said that he left two people in the house and went to Sophia. The accused said that his aunt asked about some items, which were missing from a bedroom and he told her that he had nothing to do with it.The accused said that it was the last time he saw his aunt.  He said that some days later, he was informed that Forrester’s body was found in a septic tank in the yard. Hope said the police subsequently arrested him and two other persons for the crime.
